Your access and use of the Website, App, services, and tools are governed by the following terms and conditions ("Terms of Use"), including applicable policies incorporated herein by reference, forming a valid agreement between you and Kashmironline. If you engage in transactions on the Website or App, you will be subject to the policies displayed for such transactions. Using this Website and App constitutes your binding agreement to all terms, conditions, and notices, subject to amendments without notice by Kashmironline.

Limitation of Liability

By making a booking, you understand that Kashmironline merely provides a technology platform for booking services and products, and the ultimate responsibility lies with the respective Travel Agent and/or Service Provider for its execution/performance, not Kashmironline. Thus, the ultimate contract of service is between you and the Travel Agent and/or Service Provider. In this regard, you acknowledge the following:

• ● Kashmironline assumes no liability for the standard of services provided by the respective Service Providers.
• ● Kashmironline provides no guarantee regarding their quality or fitness as represented.
• ● Kashmironline doesn't guarantee the availability of any services listed by a Travel Agent/Service Provider.

• ● Passports should be valid for at least 6 months from the date of return.
• ● Handwritten passports will not be considered valid.
• ● Passports must have a barcode.
• ● Passports should not be mutilated or tampered with.
• ● The name on the passport should match the name on other documents provided for a visa.

Force Majeure

Neither Kashmironline nor any of its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, or suppliers and their respective successors, heirs, and permitted assigns shall be responsible for or be deemed in default due to any failure to perform or delay in performance of any obligations hereunder if such performance is rendered impracticable by acts of war (declared or undeclared), sabotage, embargo, terrorism, riot, civil commotion, transportation failure, government actions, acts of God, fire, explosion, flood, earthquake, strike, governmental acts, or other catastrophes, epidemics, quarantine restrictions, or other causes beyond Kashmironline’s reasonable control (“Force Majeure”). Both you and Kashmironline will use best efforts to avoid, overcome, and mitigate the effects of any cause of an event of Force Majeure. Upon cessation of the cause of Force Majeure, the Terms of Use will again become fully operative. However, a Force Majeure event will not relieve you or Kashmironline of the obligations accrued before the occurrence of the Force Majeure.

Transaction Privity

The Website and App are platforms that offer you the means to meet and interact with agents and other service providers for organizing your travel. Kashmironline is not a party to or in control of any transaction between travel agents and other service providers. Therefore, note that:

• ● All commercial/contractual terms are offered by and agreed to between travelers and travel agents alone. The terms include without limitation price, payment methods, payment terms, date, period, mode of delivery, warranties, and after-sales services. Kashmironline does not control, determine, advise, or involve itself in the offering or acceptance of such terms between travelers and travel agents.
• ● You acknowledge that through the Website and App, Kashmironline provides a platform enabling access to various travel services offered by travel agents. It is agreed that the contract for any products or services is strictly between you and the travel agent, and Kashmironline is not privy to such contracts.

Privacy

Your privacy is extremely important to us. By accepting these Terms of Use, you confirm that you have read, understood, and unequivocally accepted our Privacy Policy.

Referral Program Terms & Conditions

Kashmironline hereby ends its Referral Program Terms & Conditions (kashmironline.com/referers/terms_and_conditions) effective from 01.04.2018. No person/subscriber shall be entitled to any Referral Amount/Kashmironline Cash in furtherance of Referral Program Terms & Conditions from the mentioned date. This Clause supersedes any other agreement/T&C provided/mentioned by Kashmironline regarding Referral Program Terms & Conditions.

Indemnification & Restrictions on Refund

The Customer agrees to indemnify, defend, and hold harmless Kashmironline, its affiliates, officers, directors, successors, and assigns from any losses, liabilities, claims, damages, costs, and expenses (including legal fees and interest) arising from any breach of representation or warranty by the User or non-adherence to any covenant by the Customer. Kashmironline reserves the right to withhold or forfeit refunds if the Customer violates any T&Cs.

Customer's Responsibility

While we value your feedback, you are fully responsible for your submissions (including reviews posted about this Website or Kashmironline on other platforms). You will not post or transmit any content about Kashmironline or its subsidiaries or affiliates that is unlawful, threatening, defamatory, obscene, or otherwise harmful and untrue, which could adversely impact the reputation of Kashmironline.
